US judge jails clerk for refusing gay marriage licenses
A county clerk was sent to jail for contempt Thursday after insisting that her â€œconscience will not allowâ€ her to follow a federal judgeâ€™s orders to issue marriage licenses to gay couples.
â€œGodâ€™s moral law conflicts with my job duties,â€ Rowan County Clerk Kim Davis told US District Judge David Bunning. â€œYou canâ€™t be separated from something thatâ€™s in your heart and in your soul.â€
The judge said she left him with no alternative but to jail her, since fines alone would not change her mind. A deputy escorted her out of the courtroom, although not in handcuffs, to be turned over to the custody of federal marshals.
â€œHer good faith belief is simply not a viable defense,â€ Bunning said, noting that allowing an individualâ€™s beliefs to supersede the courtâ€™s authority would set a dangerous precedent.
â€œI myself have genuinely held religious beliefs,â€ the judge said, but â€œI took an oath.â€
